Court Adjourns BoG, Unibank Case To October 17

Lawyers of the Bank of Ghana led by Frank Davis, have challenged the legitimacy of the General Jurisdiction Court, one of several divisions of the High Court in Ghana, to hear an application filed by founder of the now defunct Unibank, Dr. Kwabena Duffour, challenging the actions of the Bank of Ghana that has led to the revocation of the license of Unibank.

In Justice Daniel Mensah’s General Jurisdiction Court today, Lawyer Frank Davis indicated that a letter dated 26th of September 2018, has been written to the Chief Justice, Sophia Akuffo, and a copy of same has been served on the Court and the Registrar of the High Court, seeking an administrative determination by the Chief Justice of the forum (General Jurisdiction High Court) to hear a case which in their belief, is a pure commercial case which should be heard by a Commercial High Court.

Lead Counsel for the Applicants, Tsatsu Tsikata, contended that they did not have a copy of the supposed letter. Additionally, he indicated that the letter addressed to the Chief Justice by the defendants constitutes an administrative enquiry that should not stop the Court from proceeding with the matter before it.

Justice Daniel Mensah in his  ruling said as a Justice of the High Court, he is subject to the direction of the Chief Justice. To that end, he is constrained to adjourn the matter until the Chief Justice responds to the application submitted to her by the Defendant, Bank of Ghana. He thus adjourned the case to the 17th of October, 2018, for hearing.
